These terms and conditions (the "Terms and Conditions") govern the use of forefronttalent.ca (the "Website") and its Services. This Website is owned and operated by Forefront Talent. Forefront Talent Inc. is  a background performer employment agency that connects performers with casting clients.

By using this Website, you represent and warrant that you are the legal age of majority under applicable law to form a binding contract with the Forefront and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Website is the property of Forefront Talent and the Website's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Website.

Acceptable Use

As a user of our Website, you agree to use our Website legally, not to use our Website for illegal purposes, and not to:

  • Harass or mistreat other users of our Website or while working;

  • Violate the rights of other users of our Website or while working;

  • Violate the intellectual property rights of the Website owners or any third party to the Website or while working;

  • Hack into the account of another user of the Website or while working;

  • Act in any way that could be considered fraudulent;

  • Post any material that may be deemed inappropriate or offensive; or

  • Use the Website for a non-bona fide background performer opportunity-seeking purpose.

If we believe you are using our Website illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Website and your account in the database immediately and without notice. We also reserve the right to take any legal steps necessary to prevent you from accessing our Website and database.

User Contributions

Users may post the following information on our database through Production Tools:

  • Photos;

  • Name;

  • Date of Birth;

  • Telephone;

  • Gender

  • Email;

  • Address;

  • Union Status;

  • COVID Vaccination Status;

  • Past Experience;

  • Ethnicity; and

  • Appearance.

By posting publicly on our Website, you agree not to act illegally or violate these Terms and Conditions.

Accounts

When you create an account with Forefront through Production Tools, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes; and

  3. To the extent permitted by law, you are solely responsible for, and assume all liability regarding, (i) the information and content you contribute to the database; and (ii) the information and content you post, transmit, publish, or otherwise make available (hereinafter "post") through the database or through communication with Forefront; and

  4. You warrant and represent that all information provided to Forefront will be truthful, accurate, and complete, and will be submitted only for lawful purposes. You will not provide inaccurate, misleading or false information to Forefront. If information provided to Forefront subsequently becomes inaccurate, misleading or false, you will promptly notify Forefront of such change; and

  5. You will register only one unique profile and use of the service must be for bona fide background performer opportunity-seeking purposes in order to maintain the integrity of the service. We reserve the right to remove your account information or data from our services and any other records if your account and/or access to the services is terminated or if we discover your information to be false or incorrect; and

  6. Your database profile is for your personal, non-commercial use only. You will not use any information obtained from the service in order to contact, advertise to, solicit, or sell to anyone without their prior explicit consent. If you breach the terms of this subsection and send or post unsolicited bulk email, "spam" or other unsolicited communications of any kind through the service, you acknowledge that you will have caused substantial harm to Forefront and assume sole responsibility; and 

  7. Minors under the age of majority or 16, must be registered by a legal parent or legal guardian that consents to their registration. All contact methods must be registered to the legal parent or legal guardian.

We reserve the right to suspend or terminate your account if you are using our Website illegally or if you violate these Terms and Conditions.

YOU ARE RESPONSIBLE FOR YOUR BEHAVIOUR AND ACTIONS

Though Forefront strives to encourage a respectful performer experience through information on our Website and in our ‘Background Guidebook’, Forefront is not responsible for the conduct of any performer on or off set. We are not your employer. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS AND BEHAVIOUR ON AND OFF SET. YOU UNDERSTAND THAT FOREFRONT DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS DATABASE MEMBERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS DATABASE MEMBERS. FOREFRONT MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OR PERFORMANCE OF ITS DATABASE MEMBERS. Forefront reserves sole discretion to terminate your account in the database without notice if you have misused the service or behaved in a way that Forefront regards as inappropriate or unlawful. Forefront reserves the right to immediately suspend or terminate your access to any of the services, without notice, for any reason or no reason. 

You agree to indemnify Forefront if a claim is made against Forefront due to your actions. You agree, to the extent permitted under applicable law, to indemnify, defend, and hold harmless Forefront, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of our service, your content, your conduct toward other users, or your breach of this agreement.

Risks and Precautions

You assume all risks when working, and agree to take all necessary precautions when working on set. You are employed by the production, not Forefront Talent. In addition, you agree to review and follow the recommendations set forth by the production that hired you. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FOREFRONT BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, PUNITIVE, EXEMPLARY AND/OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF FOREFRONT KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL FOREFRONT AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES.

Expectations

Forefront has no obligation to screen any opportunities, or to share any opportunities with the database members, and may exclude or remove opportunities from you without any obligation to provide reasoning for removal or exclusion. You understand and agree that Forefront has no obligation to present you with any or all opportunities. Forefront may not be able to provide opportunities or bookings for everyone seeking to use its services. Further, Forefront makes no guarantees as to the number or frequency of opportunities through the service. You understand that Forefront makes no guarantees, either express or implied, regarding your potential employment with opportunities sent to Forefront, sent to you, or to which you have applied for.

We cannot confirm the accuracy or completeness of any opportunity or other information submitted by any employer or other user, including the identity of such employer or other user. Forefront assumes no responsibility, and disclaims all liability for the content, experience, accuracy, completeness, legality, reliability, or availability of any opportunity. You also understand there are many other suitable individuals on the roster that could fill any opportunity.

Bookings

When you are booked for a job, you are required to follow all work call instructions provided by Forefront and any instruction the project provides on set. You will arrive on time, camera ready in proper attire, hair and makeup ready, with all coordinating accessories to all hired work calls. You are considered booked or hired for a job when an Forefront says you are booked. At that time information for the booking will be given or the Casting Director may release your information later. Forefront is not responsible for service/agency errors on bookings or casting calls.

Anti-piracy and Confidentiality Policy

Forefront strives to safeguard its clients, studios, and production companies protected information. As a background actor registered in our database, you are prohibited from sharing any casting call information either directly or digitally. When booked through Forefront, you are strictly prohibited from the use and possession of any recording device including but not limited to audio, video, still camera or cellular phone camera while working on an project secured through Forefront’s services. All production client information viewed, read, or told verbally is strictly private and confidential. Some productions may require talent to sign an NDA directly in addition to these Forefront policies. All talent is required to abide by any production NDA policies.

Communication with Forefront

We may use the email address associated with your account to send you messages, including notifications of important changes to the service, special offers, or attempts to collect on an outstanding balance. Further, we may contact you by telephone in order to communicate with you regarding the Service. You will not harass, annoy, intimidate or threaten any Forefront employees or agents engaged in providing any portion of the Service to you.

‘No Show’ Fees

If you have failed to arrive, cancel, or ‘no show’ a booking it reflects poorly on Forefront Talent and could jeopardize our relationship with casting. You understand this could reduce the number of opportunities for other database members. For these reasons, we charge cancellation fees at the following rates:

​

  • More than 24hour notice cancellation: $25 (+HST)

  • Less than 24hour notice cancellation: $50 (+HST)

​

‘No Show’ Fees will be invoiced to you immediately. You agree to pay said invoice. Failure to pay said invoice will result in you being removed from the Forefront Database.

​

Late Fees

If you arrive late to set you hold up production and this reflects poorly on Forefront Talent and the entire database. For these reasons, we charge cancellation fees at the following rates:

  • Late fee: $10 (+HST)

​

Late Fees will be invoiced to you immediately. You agree to pay said invoice. Failure to pay said invoice will result in you being removed from the Forefront Database.

Links to Other Websites

Our Website contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Website. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability

Forefront Talent and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Website.

Indemnity

Except where prohibited by law, by using this Website you indemnify and hold harmless Forefront Talent and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Website or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

​

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and Forefront Talent are unable to resolve any dispute through informal discussion, then you and Forefront Talent agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Forefront Talent.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

We reserve the right in our sole discretion to revise and update these Terms and Conditions from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Website. You agree to periodically review the Terms and Conditions in order to be aware of any such modifications and your continued use shall be your acceptance of these.

The information and material on this Website, and the Website, may be changed, withdrawn, or terminated at any time in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Website is restricted to users or unavailable at any time or for any period.
